BORDER SEIZURE MEASURES
Border seizure measures enable holders of trade marks, patent and design rights the opportunity to stop the importation and distribution of infringing products in the European Union and in many other countries. The measures are an effective tool for the fight against counterfeiting.
In most cases, the customs authorities will only act after the proprietor has filed a formal request. The customs authorities identify and seize suspicious goods and then inform the right holder or its representatives.
The seized goods can be checked by the right holder and, if the goods are found to infringe trade mark, patent or design rights, they will be destroyed under the supervision of the customs authorities. Should the importer oppose the destruction, an action must be filed and the goods will only be destroyed after the legal proceedings are completed.
The filing of an application for border seizure measures is free of charge in the European Union. The request is granted for one year, but can be renewed indefinitely.
